TERMS OF SERVICE

1. Agreement to Terms

By accessing or using TotalTek's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not access or use our services.

2. Services Description

TotalTek provides commercial and residential technology solutions, including:

• Network cabling — residential ethernet through enterprise CAT6+ and fiber optic, including testing and certification
• Ubiquiti UniFi network design and deployment — access points, switches, security gateways, and centralized management
• Security camera and surveillance system installation, plus access control and smart locks
• Wi-Fi and point-to-point wireless solutions — mesh networks, long-range bridges, and wireless backhaul
• Office design and layout consulting, with a specialization in call center environments
• Technology consulting and infrastructure optimization

3. Service Agreements

Each engagement is governed by a separate service agreement that defines scope of work, timelines, pricing, and project-specific terms. These Terms form the general framework that applies to all services provided by TotalTek.

4. Payment Terms

• Payment terms are specified in each individual service agreement
• Late payments may incur interest charges as set out in the applicable service agreement
• All quoted fees are exclusive of applicable taxes unless otherwise stated
• Client is responsible for all applicable federal, state, and local taxes

5. Warranties and Disclaimers

TotalTek warrants that all services will be performed in a professional and workmanlike manner. Manufacturer warranties on installed equipment are passed through to the client where applicable.

EXCEPT AS EXPRESSLY PROVIDED HEREIN, SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

6. Limitation of Liability

IN NO EVENT SHALL TOTALTEK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. TOTALTEK'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to indemnify, defend, and hold harmless TotalTek and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of our services or violation of these Terms.

8. Intellectual Property

All intellectual property rights in any software, documentation, or other materials provided by TotalTek remain the property of TotalTek or its licensors. Clients receive only the limited right to use such materials as necessary for the services delivered under the applicable service agreement.

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the service relationship and not to disclose such information to third parties without prior written consent.

10. Termination

Either party may terminate services as specified in the applicable service agreement. Upon termination, client shall pay all amounts due for services performed through the termination date.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the state in which TotalTek is headquartered, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to update these Terms at any time. When we do, we will post the revised Terms on this page and update the "Last updated" date at the top. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
